Meristem Tubes & Acclimated Pots (2-Unit Minimum): These represent the apex of our clean stock pyramid. Each unit has been through meristem excision, tissue culture, and comprehensive pathogen screening. The 2-unit minimum reflects the operational reality of establishing mother plants for tissue culture multiplication—setting up infrastructure, hanging mother plants, and maintaining sterile conditions for a single unit is not economically viable. The per-unit pricing reflects the laboratory-intensive process, sterile facility requirements, and extensive testing protocols.
Certified Bin Stock (50-Runner Minimum): The propagation chain works as follows: one acclimated meristem pot is planted to establish one bin (mother plant block), which typically harvests 100-300 runners depending on growing conditions and variety. We sell runners in 50-unit increments because this represents practical logistics for harvest, grading, cold storage, and shipping. The 50-runner minimum also aligns with industry-standard planting densities and allows customers to calculate field requirements efficiently while ensuring we're not processing small, uneconomical orders.
White Tag Foundation Stock (Half Plot = 50 Plants, Full Plot = 100 Plants): Foundation plots are established field plantings that serve as mother stock for commercial nursery operations. By regulation, a full plot cannot exceed 100 mother plants. A half plot requires 50 plants for establishment. To put this in perspective: a single bin harvest of 300 runners provides sufficient material to establish three full 100-plant plots for white tag production. Pricing reflects land preparation, establishment costs, ongoing maintenance, certification fees, and the productive value of established mother stock.
All CBC plant material is produced under California Department of Food and Agriculture (CDFA) certification programs and undergoes rigorous pathogen screening.
Material is maintained in insect-proof screenhouses, greenhouse facilities, or certified field blocks with appropriate isolation distances and pest management protocols.

International Orders: Full pre-shipment payment (75% total) is required before release of phytosanitary certificates and export documentation.
Strawberry plants are living biological organisms subject to numerous environmental, cultural, and pathogenic factors beyond the control of the seller. While CBC maintains the highest standards of production and certification, plant performance is affected by factors including but not limited to: climate conditions, soil characteristics, water quality, grower practices, pest and disease pressure, handling during transport, storage conditions, and planting techniques.
California Berry Cultivars, LLC warrants only that plant material is true-to-type and free from detectable pathogens at the time of shipment or pickup from CBC's facility, as confirmed by the most recent testing conducted under our certification program.
THIS WARRANTY TERMINATES IMMEDIATELY UPON:
Inspection at Receipt: For shipped orders, buyer must inspect material immediately upon receipt. Any claims for count discrepancies, obvious physical damage during transit, or shipping errors must be reported to CBC within 48 hours of receipt with photographic documentation. CBC is not responsible for carrier delays, mishandling, or environmental conditions during transit.
International Shipments: Due to the inherent risks associated with international transport of biological material, including but not limited to extended transit times, customs delays, temperature fluctuations, and handling by multiple parties, CBC makes NO WARRANTY of any kind for international shipments beyond confirmation that material was true-to-type and pathogen-free at time of export from the United States. Buyer assumes ALL RISK for material shipped internationally.
Remedy: CBC's sole obligation under this limited warranty, if any, shall be limited to replacement of material or refund of purchase price at CBC's sole discretion. Any replacement or remedy decisions will be made on a case-by-case basis and are not guaranteed by this document.
This warranty expires: Immediately upon transfer of possession or delivery to carrier. No warranty claims will be accepted after material has left CBC's control.
CBC MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, BEYOND THE LIMITED WARRANTY STATED ABOVE. CBC specifically disclaims any warranty regarding plant performance, yield potential, fruit quality characteristics, disease resistance levels, or suitability for any particular climate, soil type, or growing system.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CBC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SALE OF PLANT MATERIAL SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE SPECIFIC MATERIAL THAT IS THE SUBJECT OF THE CLAIM.

Buyer acknowledges that successful establishment and performance of strawberry plants requires:
Buyer assumes all risk and responsibility for plant performance after receipt of material.
Inspection Upon Receipt: Buyer must inspect all plant material immediately upon receipt. Any claims for shipping damage, incorrect counts, or obvious quality issues must be reported to CBC within 48 hours of receipt, with photographic documentation.
Pathogen Claims: Any claim of pathogen presence must be supported by testing from a certified diagnostic laboratory and reported within the warranty period specified in Section 4.1.
No Claims After Planting: CBC cannot accept claims for material that has been planted, as post-planting performance is affected by numerous factors outside CBC's control.
CBC cultivars are protected by U.S. Plant Patents and/or Plant Variety Protection certificates. Purchase of plant material DOES NOT grant rights to propagate, sell, or distribute plants or plant parts without explicit written authorization from California Berry Cultivars, LLC or its authorized master licensee, Eurosemillas, S.A. Unauthorized propagation is a violation of federal law and subjects violators to legal action.
Customers purchasing foundation stock or nursery propagation rights operate under separate licensing agreements that specify authorized propagation and distribution rights. CBC shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to: acts of God, weather events, drought, freeze damage, fire, flood, government actions, labor disputes, supply chain disruptions, pest or disease outbreaks affecting our production blocks, or any other circumstances that impair our ability to produce or deliver plant material.
In the event of production shortfalls, CBC reserves the right to allocate available material among customers on a pro-rata basis or in accordance with deposit payment dates.
International customers are responsible for:
CBC will provide reasonable assistance with documentation but cannot guarantee approval of import permits or successful customs clearance. Delays or rejections by regulatory authorities are not grounds for refund once material has been prepared for shipment.
Cancellation Policy: Orders cancelled more than 90 days prior to scheduled delivery are subject to a 25% restocking fee. Orders cancelled within 90 days of delivery date forfeit the full deposit. No refunds are available for orders cancelled after material has been harvested or prepared for shipment.
Quantity Modifications: Quantity increases are subject to material availability. Quantity decreases of more than 20% within 90 days of delivery date may be subject to minimum order charges or restocking fees.
These terms and conditions shall be governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the courts of El Dorado County, California.
By submitting an order or accepting delivery of plant material from California Berry Cultivars, LLC, customer acknowledges having read, understood, and agreed to these terms and conditions. These terms supersede any prior oral or written communications regarding the subject matter herein.
